Constitution

1. NAME

  • The name of the organisation shall be "SOUTH AYRSHIRE ACCESS TO SPORT" (hereinafter referred to as "the Association")

2. AIMS OF THE ASSOCIATION

  • 2.1 To encourage sporting integration and access to sporting opportunities for people with physical or learning/re-learning impairments.
  • 2.2 To encourage and promote the development of sport and physical recreation among disabled people in South Ayrshire, in the interest of social welfare, so that their conditions of life may be improved.
  • 2.3 To seek to improve the quality of life and health and fitness of disabled people through participation in sport and in furtherance thereof but not otherwise.
  • 2.4 To facilitate access to equipment, sports programmes and facilities.
  • 2.5 To promote or support competitions, festivals and other events as considered desirable at local and national level.
  • 2.6 To encourage individuals to attend Coach Education Courses.
  • 2.7 Assist in the information of clubs in any localities where there is a need.
  • 2.8 Publish and distribute information on local clubs; local and national activities and facilities related to sport for disabled people.
  • 2.9 To act as an advisory body, to examine the available sports facilities and to make recommendations to South Ayrshire Council and to any other appropriate body in this area of work.
  • 2.10 To receive reports and recommendations on all matters concerning sport for disabled people and to take appropriate action thereon.
  • 2.11 To liaise with South Ayrshire Council and other Ayrshire Councils, Sport Scotland, Scottish Disability Sport and Ayrshire and Arran Health Board in matters relating to the development of sport.
  • 2.12 To function as a branch of Scottish Disability Sport in accordance with the constitution and aims of that body.

3. POWERS

  • 3.1 To help establish clubs and groups when and where considered to be necessary with such powers as may be considered to be appropriate.
  • 3.2 Bring together in conference and work in liaison with representatives of voluntary organisations. Government departments, local and other statutory authorities and individuals.
  • 3.3 Affiliate to appropriate bodies.
  • 3.4 Promote and carry out or assist in promoting and carrying out research, surveys and investigations and where considered appropriate publish the results.
  • 3.5 Join in the arranging and providing of exhibitions, meetings, lectures, classes, seminars and training courses.
  • 3.6 Cause to be written and printed or otherwise, reproduced and circulated, free of charge or for payment, such papers, books, periodicals, recorded tapes (whether audio or visual or both) as such further the aims.
  • 3.7 Subject to such consents as may be required by law, or raise money for the aims and accept gifts on such terms and on such security as shall be deemed to be necessary.
  • 3.8 Raise funds and invite and receive contributions from any person or persons whatsoever provided that the Association shall not undertake permanent trading activities in raising funds for the said objects except by means of a company established for that purpose.
  • 3.9 If necessary employ and pay any person to organise and develop the work of the Association.
  • 3.10 If necessary employ and pay fees to professional and technical advisers/consultants to assist in the work of the Association.
  • 3.11 Do all such things as are necessary for the attainment of the aims of the Association.

4. MEMBERSHIP

  • 4.1 Membership shall be open to all persons in South Ayrshire who have physical, sensory or learning/re-learning impairments.
  • 4.2 Any individuals, organisations and schools connected with sport for disabled people in South Ayrshire may apply for affiliation to the Association, subject to agreeing to abide by any rules which may be made by the Association.
  • 4.3 The Association will have the power to grant, review or terminate membership in accordance with the articles of constitution.
  • 4.4 Each affiliated member shall have one vote regardless of membership category.
  • 4.5 Membership fees, if applicable, will be set at the AGM.
  • 4.6 Application for membership shall be formal application to the Secretary.

5. EXECUTIVE COMMITTEE OF THE ASSOCIATION

The management of the Association shall be carried out by an Executive Committee consisting of the following:

(a) Chairperson
(b) Vice Chairperson
(c) Secretary
(d) Treasurer
(e) Sports Development Officer
(f) Junior Development Officer
(h) Sports Council Representative
(i) Disabled Athlete Representative

  • 5.1 The members of the Executive Committee shall retire at the Annual General Meeting of the Association but shall be eligible for re-election.
  • 5.2 The Executive Committee shall have the power to co-opt persons who could contribute greatly to the work of the Association.
  • 5.3 The Executive Committee shall meet at such intervals as they may determine having regard to the business to be transacted, but no less than 8 times per annum.
  • 5.4 The Executive Committee shall have power to appoint from among their number such sub-committees and Chairperson thereof as they deem necessary in order to carry out the objects of the Association and to co-opt thereto such additional persons as they may think desirable in the circumstances of each case.
  • 5.5 The notice calling the Annual General Meeting of the Association shall be forwarded to members at three weeks prior to the meeting.
  • 5.6 The Executive Committee shall submit reports of its activities to the Annual General Meeting.
  • 5.7 The Executive Committee will appoint individuals to represent the branch on external organisations as deemed appropriate.

6. OFFICE BEARERS

  • 6.1 The Office Bearers of the Association shall be Chairperson, Vice Chairperson, Secretary and Treasurer who will be appointed annually at the Annual General Meeting.
  • 6.2 The Association may appoint an Honorary President and Honorary Vice President who shall be ex-officio.

7. MEETINGS

  • 7.1 The Chairperson, whom failing Vice Chairperson, shall preside at the meetings of the Association and the Executive Committee. In the absence of both the Chairperson and the Vice Chairperson those present, as appropriate, shall appoint one of their number to preside.
  • 7.2 The Annual General Meeting of the Association shall be held in the month of September each year.
  • 7.3 Notice of Motions for the Annual General Meeting must be submitted six weeks in advance.
  • 7.4 The Quorum for meetings of the Executive Committee shall be 5.
  • 7.5 All meetings of the Association and meetings of the Executive Committee shall be called by the Honorary Secretary and 14 days notice in writing shall be given as to the time and place thereof and the business to be considered insofar as is known, in the case of meetings of the Association. Meetings of Sub- committees of the Executive Committee shall be called by the Honorary Secretary in association with the Chairpersons of such Sub-Committee as may be agreed between them.
  • 7.6 A Special General Meeting of the Association shall be held if requisitioned by the Executive Committee or by any 6 of the affiliated clubs or organisations, by letter in writing addressed to the Honorary Secretary and stating the nature of the business proposed to be considered at such meeting. Any Special General Meeting of the Association so requisitioned shall be held within 21 days of receipt by the Honorary Secretary of such requisition.
  • 7.7 Meetings of the Association shall be called by notice addressed to the Secretaries of the affiliated clubs, organisations and individual members as appropriate and meetings of the Executive Committee and Sub-Committees thereof by notices addressed to the individual members thereof.
  • 7.8 Voting at meetings of the Association and the Executive Committee shall be on the basis of one vote per member present and the Chairperson shall have a casting vote as well as a deliberative vote. Voting shall be by a show of hands or by roll call as may be decided by the Chairperson.
  • 7.9 Proposed amendments, if any, to the constitution must be given in writing to the Honorary Secretary not less than 21 days prior to the Annual General Meeting or as a request for a SGM.
  • 7.10 The Honorary Auditor shall be appointed at the Annual General Meeting for the following year.

8. FINANCE

  • 8.1 All funds raised by or on behalf of the association shall be applied to further the aims of the Association and for no other purpose; the preceding provision shall not, however, prevent the payment in good faith of reasonable and proper remuneration to any employee of the Association and the feed to professional and technical advisers or the repayment to members of the Executive Committee or of any Committee or Sub-Committee for reasonable out-of-pocket expenses.
  • 8.2 Proper accounts shall be kept by the Honorary Treasurer who shall be responsible for advising the Association on all financial matters affecting the Associations activities;
  • 8.3 The Associations financial year runs from 1st April to 31st March in each year.
  • 8.4 The Association may receive grants from South Ayrshire Council and from other agencies wishing to support the Association.
  • 8.5 Monies received on behalf of the Association shall be paid into a bank or building society account in the name of "South Ayrshire Access to Sport" as approved by the Executive Committee.
  • 8.6 All cheques drawn against the Association's account shall be signed by any two from the Honorary Treasurer, Chairperson or Secretary.
  • 8.7 An audited Statement of Accounts for the year to 31st March preceding shall be presented to the Association at each Annual General Meeting.

9. WINDING UP

  • 9.1 The Association shall not be wound up except by Resolution carried by a majority of two thirds of those present and voting at a Special General Meeting of the aforementioned Association called for the purpose.
  • 9.2 In the event of the Association being wound up, all the unallocated funds of the Association shall be handed over to an appropriate organisation for such exclusively charitable purpose connected with sport and recreational activities for people with disabilities as determined by the Executive Committee.
